Privacy Statement


We have an ethical responsibility and a legal obligation to maintain the confidentiality and privacy of client health information obtained while providing our highest standard of care to our clients.

Privacy policy is based on the federal Personal Information Protection and Electronic Documents Act (PIPEDA) that governs the commercial relationship between organizations and individuals who are our clients or potential clients.  Personal Health Information Protection Act (PHIPA), 2004, governs health care information privacy in Ontario.  Information privacy is defined as the client's right to control how his/her personal health information is collected, used and disclosed.   

What is Personal Information?

Personal information is any identifying information in verbal, written or electronic form that can be used to distinguish, identify or contact a specific individual.  It is important to note that there is a distinction between personal and business information in that business information does not fall under the protection of privacy legislation.

Accountability

Kellie Radley Occupational Therapy Professional Corporation is responsible for personal information under its control.  There is a designated Privacy Officer who is accountable for the compliance of privacy principles.

Identifying Purposes

The purposes for which personal information is collected shall be identified at or before the time the information is collected.

Obtaining Consent

The knowledge and consent of the individual are required for the collection, use or disclosure of personal information except where inappropriate. All professionals shall obtain informed consent from all clients.  Clients will have sufficient information about the services being recommended and potential consequences in order to all him / her to make the decision.

Limiting Collection

The collection of information shall be limited to that information which is deemed necessary for the purposes identified by Kellie Radley Occupational Therapy Professional Corporation.  Information shall be collected by fair and lawful means.

Limiting Use, Disclosure and Retention

Kellie Radley Occupational Therapy Professional Corporation shall not use or disclose personal information for purposes other than those for which it was collected, except with the informed consent of the individual or as required by law. Kellie Radley Occupational Therapy Professional Corporation shall retain personal information only for as long as necessary to achieve fulfillment of the identified purposes.  In accordance to the College of Occupational Therapists of Ontario, Kellie Radley Occupational Therapy Professional Corporation maintains client health records for at least 10 years from the date of the last entry in the record.  In the case of children, client health records are retained for 10 years after the date on which the client reached, or would have reached, 18 years of age. 

Accuracy of Personal Information

Kellie Radley Occupational Therapy Professional Corporation shall keep personal information as accurate, complete and up-to-date as is necessary for the purposes for which it was collected to be used.

Safeguards

Kellie Radley Occupational Therapy Professional Corporation shall protect personal information by security safeguards appropriate to the sensitivity of the information. Destruction of information / records are done in a secure manner that prevents anyone from accessing, discovering or otherwise obtaining the information.  Kellie Radley Occupational Therapy Professional Corporation is aware of the importance of a maintaining confidentiality of personal information.

Openness of Privacy Practices

Kellie Radley Occupational Therapy Professional Corporation makes specific information about privacy policies and practices related to the management of personal information readily available to clients and potential clients.

Client Access

Kellie Radley Occupational Therapy Professional Corporation shall, upon request, inform a client of the existence, use and disclosure of his / her personal information and shall give the client access to that information.  A client shall be able to challenge the accuracy and completeness of the information and have it amended as appropriate.

Challenging Compliance

A client shall be able to address a challenge concerning compliance with the above principles to the designated Privacy Officer accountable for company compliance.
